The registered office is not the address for returning goods. Returns are sent to an address in France, provided to the customer with the return instructions.

Article 2 – Scope and acceptance

These Terms and Conditions of Sale apply to distance sales of products to consumers through artisanat-shop.com. They set out the terms governing ordering, payment, delivery, withdrawal, exchanges and warranties. Customers may review and retain a copy before placing an order. The terms applicable are those accepted on the order date.

Article 3 – Products and availability

Essential product characteristics, including the nature, materials, dimensions and prices, are provided on each product page. As some items are handmade, minor variations may occur, without affecting the advertised essential characteristics or the customer's statutory rights.

Offers are subject to stock availability. If an item becomes unavailable after an order has been placed, Artisanat Shop will notify the customer and may offer a replacement item, which the customer is under no obligation to accept. If no agreement is reached, the sums paid for the unavailable item will be refunded in accordance with applicable rules.

Article 4 – Prices, taxes and import charges

Product prices and currencies are displayed on the website. Taxes included in the price, delivery charges and any other charges payable to the seller are shown before order confirmation. The applicable price is the price accepted by the customer when confirming the order.

For deliveries outside the European Union, customs duties, import taxes or customs clearance fees may apply. Where these amounts are not expressly included in the stated price or shipping charges, they remain payable by the recipient, subject to the information provided before purchase and applicable rules.

Article 5 – Placing an order

The customer selects the desired products and quantities, enters their contact and delivery details, selects an available delivery method and reviews the order summary and total price before confirming an order involving an obligation to pay. Information can be corrected before confirmation. An order confirmation is sent to the email address provided.

Customers must provide accurate information and promptly report any errors. Questions about orders can be submitted through the contact form.

Article 6 – Payment

The website accepts payment by bank card and PayPal, subject to the options available at checkout. Payments are processed by the relevant payment service providers using appropriate security measures. Artisanat Shop does not store full payment card numbers.

Orders are prepared following payment confirmation, unless special arrangements have been expressly communicated to the customer.

Article 7 – Delivery

7.1 Destinations and delivery methods

Delivery is offered to the destinations available during checkout. Depending on the destination and parcel characteristics, carriers may include Colissimo, Chronopost, Mondial Relay, DHL Express or another service provider offered at checkout.

7.2 Delivery charges and free shipping offers

Subject to the eligibility of the destination, items and delivery method, the usual promotional offers are:

  • Metropolitan France: free Mondial Relay delivery on orders of €30 or more.
  • Belgium, the Netherlands, Luxembourg, Germany, Spain, Portugal and Italy: free Mondial Relay delivery on orders of €50 or more, where this service is available.
  • Other eligible destinations: free home delivery on orders of €100 or more, subject to the displayed conditions.

The delivery charges and conditions actually displayed before order confirmation apply to that order. Free delivery offers do not apply to ineligible methods or destinations.

7.3 Delivery times and delays

The delivery period or date is communicated before the order is placed. Any estimates on information pages do not replace the delivery period agreed at the time of purchase. If no other period is agreed, goods will be delivered within the period required by applicable law.

In the event of delay, the customer has the remedies provided by law, including, where applicable, allowing a reasonable additional period for delivery and then terminating the contract if delivery still does not occur. Circumstances allowing immediate termination remain unaffected.

Article 8 – Receipt, damage and loss

On receipt, customers are invited to check the items and report damaged, missing or non-conforming goods as soon as possible through the contact form, quoting the order number and providing photos where possible. Failure to provide photos or to raise an immediate reservation does not remove statutory consumer rights.

Where the seller arranges transportation, the seller bears the risk of loss or damage until the goods are physically received by the customer or a third party designated by the customer other than the carrier, subject to statutory exceptions.

Article 9 – Right of withdrawal

9.1 Withdrawal period

For eligible distance sales contracts, consumers generally have 14 calendar days starting on the day after receipt of the goods to communicate their decision to withdraw without giving a reason. Where several goods under one order are delivered separately, the period generally starts upon receipt of the last item.

9.2 Notice of withdrawal

Customers are invited to notify withdrawal using the contact form, specifying their order number and their decision to withdraw. They may also send any unequivocal statement to contact@artisanat-shop.com, use the model form in the appendix or the electronic withdrawal function provided on the website.

A notice sent within the statutory period is sufficient to exercise the right of withdrawal: prior authorisation from Artisanat Shop or prior receipt of a return form is not required. Acknowledgement of receipt will be provided in accordance with applicable obligations.

9.3 Return form and French return address

After receiving the request, customer service will provide a return address in France, practical instructions and an administrative return form to identify the order and returned items. Customers are invited to include this form in their parcel to facilitate processing.

This return form is not a shipping label or a prepaid return label. It is not a condition for validly exercising the right of withdrawal.

9.4 Returning goods, costs and condition

Customers must send back the goods without undue delay and no later than 14 days after communicating their decision to withdraw. The deadline is met if the goods are dispatched before it expires. The direct shipping cost of returning goods is payable by the customer, unless a statutory exception or a more favourable commercial arrangement expressly applies.

Customers may inspect goods as they would in a shop. They may be liable for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods. Missing original packaging does not automatically remove the right of withdrawal.

9.5 Exceptions

The right of withdrawal does not apply to purchases covered by a statutory exception, such as certain goods made to the consumer's specifications or clearly personalised. Where an exception applies, the customer is informed before placing the order.

Article 10 – Voluntary exchanges

Separately from the right of withdrawal and statutory warranties, Artisanat Shop offers voluntary exchanges, subject to availability, particularly for size changes. Customers must request an exchange within 14 days of receipt through the contact form.

Customer service will provide the French return address, instructions and an administrative return form (not prepaid). The customer pays the cost of sending back the original product. Artisanat Shop covers the shipping cost of the first dispatch of the replacement item. Any further dispatch is subject to terms communicated to the customer before agreement.

To qualify for this voluntary exchange, items must be in a condition allowing resale, without prejudice to mandatory consumer rights. If the requested item is unavailable, an alternative may be proposed without limiting a timely exercise of the right of withdrawal or statutory warranties.

Article 11 – Refunds

In the event of a valid withdrawal, Artisanat Shop will refund the sums owed without undue delay and in any event within 14 days of being informed of the customer's decision. For sales of goods, the refund may be withheld until the goods have been received or the customer provides proof of having sent them back, whichever occurs first.

Where withdrawal covers the entire order, the refund includes the amount paid for the goods and the original delivery charges, up to the cost of the least expensive standard delivery option offered. Additional charges arising from the customer's choice of a more expensive delivery option need not be refunded. For partial returns, the original delivery charges are handled according to applicable rules.

The refund will be made using the original payment method unless the customer expressly agrees to another method that does not incur additional charges.

Article 12 – Statutory warranties

Products benefit from applicable statutory warranties, independently of any voluntary exchange service or additional commercial warranty.

12.1 Legal guarantee of conformity

The seller must deliver goods that conform to the contract. Under the conditions of applicable law, consumers may request repair or replacement, and subsequently, where statutory conditions are met, a price reduction or termination of the contract. Bringing goods into conformity is free of charge for consumers.

For consumers protected by French law, the legal guarantee of conformity generally covers defects of conformity arising within two years of delivery. The statutory rules on procedures, periods and presumptions apply.

12.2 Warranty against hidden defects

Where French law applies, Articles 1641 and following of the French Civil Code also protect buyers against hidden defects that make goods unfit for their intended purpose or substantially diminish their usefulness, subject to statutory conditions.

12.3 Making a claim

To report a defect, customers may use the contact form or email contact@artisanat-shop.com. Customer service will explain the process and, if a return is required, provide instructions and the return address. Costs necessary to exercise statutory warranty rights are borne in accordance with the law and are not treated as the return shipping costs for a simple withdrawal.

Article 13 – Complaints and alternative dispute resolution

For complaints, customers may contact customer service by telephone on (+33) 01 85 09 42 37, by email at contact@artisanat-shop.com or through the contact form. Artisanat Shop will seek an amicable resolution.

If the dispute remains unresolved, consumers may refer the matter to a competent alternative dispute resolution entity under applicable law. [To be completed before publication: name, contact details and website of the competent mediation / alternative dispute resolution entity for Artisanly OÜ and the consumers concerned.]

Article 14 – Liability and force majeure

Artisanat Shop remains responsible for its obligations under applicable law. Where an event legally qualifies as force majeure, performance of the affected obligations may be suspended or the contract terminated under the conditions provided by law. Nothing in these Terms and Conditions limits statutory warranties or other mandatory consumer rights.

Article 15 – Governing law and competent courts

These Terms and Conditions are governed by Estonian law. This choice does not deprive consumers of the mandatory protections of the law of their country of habitual residence where applicable private international law rules grant such protections, in particular Article 6 of Regulation (EC) No 593/2008 (Rome I).

Disputes fall within the jurisdiction of the courts competent under the rules applicable to consumer contracts. These Terms and Conditions do not impose an exclusive court on consumers in breach of their rights.

Article 16 – Amendments

Artisanat Shop may amend these Terms and Conditions for future orders. Orders already concluded remain governed by the conditions accepted when the order was confirmed, subject to applicable mandatory legal provisions.

Appendix – Model withdrawal form

Complete and send this form only if you wish to withdraw from the contract. Use of this template is optional: any unequivocal statement is acceptable.
